01. They just detained my husband at the airport. What do I do in the next hour?

Accepted Answer

Call an immigration attorney today, then write down his full name, date of birth, A-number if you have it, and exactly where and when this happened. Find him through ICE's Online Detainee Locator System or the ICE line at (866) 347-2423. Get one message to him however you can: sign nothing. Then pull together your marriage certificate, receipt notices, lease, and pay stubs — that folder is what a lawyer uses to argue for release.

02. Can ICE really detain me if my green card case is pending?

Accepted Answer

Yes. That is what changed in 2026 — arrests have reached people with pending applications and valid work permits, which was rare before. Your pending case still matters enormously, though. It is central evidence in a request for release and in any defense, and an arrest does not withdraw it.

03. Could I be deported without ever seeing a judge?

Accepted Answer

That is the real risk expedited removal created, and it is why we treat this as urgent. Two things push back against it: showing two years of continuous presence in the U.S., and stating a fear of return, which triggers a screening interview. Neither is automatic — nobody is required to tell you these protections exist. You have to raise them yourself and back them up with documents.

04. Should I cancel my flight?

Any lawyer who answers that without reading your file is guessing. If you have an expired visa, a pending case, or any past contact with immigration enforcement, get a case review before you travel. For some people the risk is manageable with the right paperwork in hand. For others we would say wait, and we would explain exactly why.

05. My visa expired years ago. Am I automatically here illegally?

Accepted Answer

Not necessarily, and the distinction is technical enough that it is worth having a lawyer look. Your visa governed admission; your permission to stay came from your I-94, and filings like a pending I-485 or a timely extension can keep you in a period of authorized stay. Enforcement policy currently lumps all overstays together, but the legal categories are still separate and still argued successfully.

06. Can I even board a domestic flight without a REAL ID?

Accepted Answer

Usually yes. A valid unexpired foreign passport is accepted on its own, and so are a green card, an EAD, a border crossing card, and DHS trusted traveler cards. A visa stamp or I-94 printout alone will not get you through the checkpoint — carry those as proof of your situation, not as your ID.

07. Can they search my phone at the airport?

It depends on who is asking and where. At a port of entry, CBP claims broad authority to search, copy, or hold devices, and refusing to unlock can have serious consequences for a visa holder. Inside a domestic terminal, ICE generally needs a warrant to search your belongings. This is one of the most fact-specific areas in immigration law right now — ask about your own situation before you travel rather than after.
