01. What is the difference between a Habeas Corpus petition and removal defense?

Habeas Corpus is filed in Federal District Court and challenges the detention itself — the goal is physical release. Removal defense is handled in Immigration Court and challenges the government’s right to deport someone. They are separate cases with separate goals. Many clients need both, and we will explain clearly which service covers what.

02. How long does someone need to be detained before filing?

Accepted Answer

Six months (180 days) is the benchmark federal courts use when evaluating whether detention has become unreasonable. Under Zadvydas v. Davis, detention past 180 days after a final order of removal is presumptively unreasonable if deportation is not reasonably foreseeable. That said, some cases are worth filing sooner — especially when medical conditions are involved.

03. What if my family member’s home country won’t accept them back?

Accepted Answer

This is one of the strongest grounds for a petition. When a final removal order exists but the home country refuses to issue travel documents, the detention can have no end date — and that is exactly the kind of indefinite detention federal courts have ruled is unconstitutional.

04. Does a Habeas Corpus petition affect the underlying immigration case?

Accepted Answer

No. The petition addresses only physical liberty — whether the detention is lawful. It does not decide the merits of the immigration case, grant legal status, or stop removal proceedings. Those continue separately.

05. What if bond was never requested from the Immigration Judge?

Accepted Answer

A federal judge will generally dismiss a Habeas petition if the immigration court process was never started. If bond has not yet been requested, we handle that step first to properly preserve the record before filing in federal court.
