01. My visa was refused this year because of my country. Do I have a visa now?

Accepted Answer

No. If the refusal rested only on that policy, it has been set aside and your case goes back for a real, individual decision. That decision has not been made yet, and it can still go either way based on your own circumstances.

02. Should I call the embassy or the National Visa Center to ask about my case?

Accepted Answer

Not right now. There is no reconsideration request to file and no line to get into, and the State Department has not issued guidance to posts yet. Calling adds nothing and can create a confusing record. Let your attorney handle contact in writing.

03. Does this affect my tourist or student visa?

Accepted Answer

No. The policy only covered immigrant visas — family and employment-based permanent residence. Tourist, student and other nonimmigrant categories were never part of it, so nothing about them changed with this ruling.

04. My refusal mentioned other reasons besides the policy. Where does that leave me?

Accepted Answer

Refusals supported by an independent legal ground still stand, even where the officer also cited the ban. That is exactly why the refusal sheet needs to be read closely — the difference between “policy-only” and “policy plus something else” decides whether this ruling reaches you.

05. Can the government undo this ruling?

Accepted Answer

It can try. The administration may appeal to the Second Circuit or ask for a stay, and as of August 24, 2026 it has not said which way it is going. Both sides also have until September 11 to propose how to resolve the rest of the case. We will update this page as it moves.
