Are Muslim Visa Applicants Dealing With Unfair Administrative Processing Delays?
Administrative processing is not something that's exclusively for Muslims or people from majority Muslim countries. However, it does feel that way because so many of my clients are from Muslim countries or are Muslim.
I think part of the explanation for why so many people are stuck in administrative processing is that administrative processing is a form of bigotry where Muslim applicants are targeted for this delay. Nothing official has ever been said, of course.
From that, we can draw our own conclusions based on the fact that most of the people who contact me are from Pakistan, Morocco, Saudi Arabia, or other majority Muslim countries. However, I have plenty of clients who are from other countries like Vietnam, China, or London, who are not Muslim and still have to deal with this issue.
How Long Does Administrative Processing Take?
There is no way to know how long administrative processing will take regardless of your religion, whether you're Muslim or not. Administrative processing takes however long it takes.
Unfortunately, that is one of the most difficult and frustrating aspects of administrative processing because you do not have any idea as to how long the process is going to take.
To make matters even worse, there tends to be misleading communication from the consulate. For example, you will receive an email from them that will say, "Please check back in 30 or 60 days." This type of email might make you think that the administrative processing will be cleared up within a certain specific period of time. Oftentimes, it is the opposite outcome.
There are no statistics about how long administrative processing takes. Whether you are Muslim, Jewish, Christian, or even atheist, the length of time that administrative processing takes is absolutely uncertain.
No one can say exactly when your visa will be approved. If you are in administrative processing, you could be approved tomorrow, or we have clients who have been waiting several years for administrative processing to end.
How Can An Immigration Attorney Help With Administrative Processing Delays?
I know that may not be very comforting news, however, these are the facts. But, do not give up hope.
This is why I help people, and I do it by filing mandamus lawsuits. If you are stuck in administrative processing, you do not have to just sit and wait for years dealing with your immigration case.
In fact, you can sue them. This is where my immigration law firm and I come in. We can file a mandamus lawsuit and challenge this delay by fighting it in court.
When we file the lawsuit, the consulate will issue you your visa. You can end the delay and you do not have to wait indefinitely.
If you are ready to take action, then I want you to reach out and message me. And let's get in touch and let's come up with a plan to fight this. Take care.
