Getting you US F-1 visa stuck in administrative processing can be frustrating. However, Faayed Al Faisal’s F1 visa delay success story shows there’s always hope. If you are willing to take action, you can find a way forward.
After a two-year delay on his F1 visa, Faayed thought he had run out of options. He shared his US F-1 study visa story. Continue reading to find out how he was finally able to move forward with his dream of studying in the U.S.!
The Beginning of Faayed’s F1 Student Visa Journey
Faayed's journey to obtaining his F1 student visa was not easy. He faced an F1 visa delay that lasted two years. During this time he experienced significant emotional and personal hardships.
His career goals were on hold, and he had to forgo valuable employment opportunities because he couldn't commit to them due to the F1 visa delay. As Faayed reflects on his experience, he shares his story to help others who might be facing similar challenges.
Faayed reflected:
"What was about to happen was I was about to get more serious into job hunting, which I wasn't necessarily doing before because I couldn't commit to any job to a contract that in Pakistan we have to sign contracts for a year or a certain amount of time which I wasn't comfortable doing before. Now, I was about to give up, I thought."
The Emotional Toll of the F1 Visa Delay
His F1 visa delay began when he applied to study computer science at the University of South Florida. There he had been accepted into a Ph.D. program focusing on developing new protocols for the Internet of Things.
However, his application got stuck in administrative processing at the U.S. consulate in Islamabad. The administrative delay caused his F1 visa delay, leaving him to feel stressed and insecure about his future.
Faayed explained:
“I had to deny a job offer as they required a long-term commitment, which I couldn’t do,”
How Long Do Student Visas Take to Process?
The processing time for F1 visas can vary, and for many, the waiting can be overwhelming. The uncertainty of his F1 visa delay not only affected his educational ambitions but also led to financial hardship. He was unable to take job offers in his home country, and he was forced to work as a freelancer to make ends meet.
Deciding to Take Mandamus Legal Action
He learned that pursuing a mandamus lawsuit could push the government to decide on his visa. It was his parents who discovered our firm online and suggested giving us a chance. With little hope left, Faayed decided to take a leap of faith and hire us.
Faayed shared:
“My parents suggested and found you guys online and they were like, Let’s just give this a try, give this a chance. Then whatever happens, happens.”
Many people worry that suing the U.S. government or a consulate might hurt their chances of approval. Getting a Boston Writ of Mandamus lawyer would help him deal with the F1 delays he faced.
Faayed remembered not being worried:
“I didn't really it wasn't my concern what they thought, because it was already a ‘no’ in my head. I was going in with the thought of, hey, it's already not happening. It didn't seem like it's going to happen.”
“So why not just sue them? It's fine. You know, what's the worst thing that's going to happen? Nothing's going to change. So, yeah, that's about it.”
Getting F1 Visa Mandamus Success
Once we filed the mandamus petition, things started to change. The F1 processing time improved significantly. Amazingly, Faayed received news of his F1 US student visa approval within about two months.
Faayed remembered his joy and relief:
“I think it was two or three months, and then I got my visa. The first thing I did was email you guys and say, ‘It’s done!"
This was a huge relief for him and a turning point in his journey. He was especially anxious about his upcoming start date for the Ph.D. program in August 2024, fearing he might lose his spot if the F1 visa delay continued.
Faayed remembered the exact moment:
“I was just relieved. The first thing I did was email you guys. I said it was done. I got my visa. Thank you so much. I was away from the city, wasn't with my family. I texted them. It was like 11pm at night or 12 a.m. close to midnight. I saw it was just freaking out. I was really happy.”
Looking Ahead to a Bright Future
Faayed was days away from heading to Florida to begin his studies. When asked about his future, he’s keeping an open mind. He encourages others facing F1 visa delays to seek help when needed.
Faayed shared:
“The one lesson that I learned is to do what you can right now and focus on that. So hopefully I can land a career I think would be beneficial for my family in general, just to help out my whole family. That would be great. But if not, a Ph.D. in America is just worth a lot in Pakistan itself.”
