Today I got a question from a prospective client: “I have a question regarding the payment. You are asking for full payment at the beginning. Can I pay half at the beginning and the other half after I get the visa approved?” Let me answer that, and explain how it works.
In case you don’t know me, my name is Josh Goldstein, and I’m an immigration lawyer in Los Angeles. I help people and families get their visas out of administrative processing.
How I help people
I do that by filing writ of mandamus lawsuits. I sue consulates around the world to help people whose visas have gotten stuck, and when someone wants to hire me, I give them a flat fee quote. I charge a flat fee to cover all the services related to my work. I don’t charge by the hour.
Why I charge a flat fee
The fee I charge varies based on a number of factors, including the complexity of the case, the consulate, and other things. That’s why I say: “Let’s have a conversation so I can learn a little more about your case, about your situation, and find out whether I can help you, and if so, how much I would charge”
When I give someone a flat fee quote, I ask for payment in full at the beginning of the case. The reason that I do this is because as soon as someone hires me, I file a lawsuit. Literally. If I can, I’ll file it within a day or perhaps two days. I file it immediately because the sooner I file the lawsuit, the sooner your visa is approved.
The timing matters
If you hire me, and I don’t file the lawsuit, nothing’s going to happen. After I file a lawsuit, the visa is usually approved within six to twelve weeks, so things happen very quickly. This is not the type of case that’s going to drag on for years, and you can make a payment each month.
I have cases like that, but this isn’t one of those. This is something quick. You’re gonna hire me, you pay, I file the lawsuit, you’re done. It’s going to happen very quickly, so it’s not the type of interaction where there’s work that’s going to be unfolding over a very long period of time and the payments could be like that as well.
One alternative option
Here’s what I offer people that don’t have all the money and want to pay over time: I accept payment by credit card. So if you don’t have all the money, you can pay with a credit card, and then you can make monthly payments to your credit card over time. That gives some people a little bit more flexibility. I hope that answers your question.
